General Terms & Conditions applicable to all Customer Agreements
In consideration of any agreements or contracts entered into will be with the Perfumery Art School UK Ltd. (Incorporated in England under Companies House registration number 08356910 with registered Office at 29 Brigg Drive, First Lane, Hessle, East Yorkshire HU13 9HG, United Kingdom)
1. Definitions
For the purposes of these terms:
'We' and 'Us' means The Perfumery Art School UK who will provide the service to you.
'You' means the student receiving the services.
'Course' means a distance learning course or an optional practical course when applicable.
'Course Materials' means the materials relating to any one course, together with all revision and updates made by us from time to time, which may be in any format and which are required by the student to complete the course.
Headings are included for convenience only and shall not affect the construction or interpretation of this Agreement
2. Cancellations & refund policy
2.1 course cancellation
We offer a money back guarantee on our courses in line with current distance learning government legislation (Consumer Distance Selling Regulations Act 2000), this being an email stating your wish to cancel sent to us within seven days of receiving the first link to your online resources.
Please note the terms and conditions below regarding the charges for the raw materials kits in case of cancellation and when the kit has already been shipped.
NOTE that any refund will only be made to the original bank account or credit card paid at the time of application. under no circumstances will we accept refunds to any other accounts or person.

The postal date on the envelop or the date of the email should be no later than within the seven days period of receiving the first link to your online resources.
The Perfumery Art School UK will not grant requests to cancel out of legislative period in any circumstance.
It is to be noted that a charge of GBP 750 is automatically applied to cover the cost of the starter kit and shipping fees if the raw materials kit has already been shipped to the student. We will not accept the return of any starter kit already sent under any circumstances and regardless whether the cancellation has been made within the cancellation period or not.
2.2 REFUNDS OR PARTIAL REFUNDS FOR PAYMENTS MADE WITH PAYPAL
to reflect the new paypal PAYMENT policy in relation to refunds and/or partial refunds that will be enacted as of 1st october 2023, please note that any refund - whether full or partial - will be made deducted of ANY paypal TRANSACTION fees that were charged to us (the seller). THIS MEANS THAT THE RETURNED AMOUNT COULD BE LOWER IN VALUE THAN THE ORIGINAL AMOUNt EITHER BECAUSE THE REFUND IS ONLY PARTIAL OR BECAUSE OF TRANSACTIONS FEES (E.G. CURRENCY CONVERSION FEES, credit card fees).
these transactions fees can vary between 2.9 to 10% of the price, depending on which country you are in and which currency you made the transaction with at the time.
as our lead currency is gbp (£), please note that if you use other currencies such as USD ($) or EUR (€), you will be charged based on the current conversion rate used by paypal and any refund will be made based on the rate calculated by paypal (which is usually unfavorable to you or us).
IN ORDER TO AVOID any LOSS ON YOUR PART, WE STRONGLY RECOMMEND YOU ENSURE THAT YOU CHOOSE THE APPROPRIATE CORRESPONDING COURSE PROGRAM IN THE FIRST INSTANCE.
depending on the refund amount, we may give you a discount or gift voucher to use in our webshop or alternative outlets in order to offset or compensate the loss.

if you do not wish to use paypal for payment for your enrolment or any other product or service we offer or if you use another currency, you may pay by credit/debit card using stripe payment or pay by bank transfer (bank fees at your expense) upon request.
3. Responsibility for course materials
until further notice, starter kits are only available for those students from the united kingdom, northern ireland and the eu area. We affirm that the course materials will meet a satisfactory level of quality however, We do not affirm that they will be error free.
You will be responsible for inspecting the course materials promptly. Furthermore, you will be responsible for informing us about any oversights within 24 hours of receipt. We will endeavour to replace those goods that are damaged (against proof of evidence about the damaged item either sent back to us or a picture of the full kit and a close picture of the damaged items emailed. Note that you should not remove any labels before taking the picture).
The School cannot be held liable for any customs taxes or related charges incurred by the student for the receipt of their kit. The Student should enquire about their local regulations and arrange accordingly in order to receive their goods in order. The School will always attach the required documents with the shipment bill including proforma invoice, declaration of purposes and use a courier company of international standing in order to facilitate customs clearance. Certificates of analysis requested by the Ministries of Health of some countries will also be provided if required.
However the student remains the sole responsible for customs clearance duties and any other charges required by the authorities in their country.
4. Conditions of use
All physical products (being the starter kit content) are in stock at the time of publication, The Perfumery Art School UK cannot guarantee that any particular item is available and therefore take no liability for any products that are sold out. In the event of a product being unavailable and an order accepted, We will endeavour to find an alternative, if this is not possible a full refund will be given.
All goods are subject to UK taxes (if applicable), and are included in the price. Claims for damaged goods must be made in writing via email within 48 hours of receipt. The Perfumery Art School UK accepts no responsibility for claims made after this period.
Please note that We are only able to communicate with the student directly enrolled with The Perfumery Art School UK, and who has a valid student number. We will not communicate with any third party.
For the ease of administration and intellectual property matters, the school will not provide hard copies of any of our online courses (See our Section 4 ''Conditions of Use - Course materials for details). Therefore, the applicant will need to ensure that their computer is in working order.
Please note that to ensure quality of the learning, only module 1 shall be sent to all students within the 7 days period. Each consecutive module will then be sent after completion of the assignments of the previous module.
The enrolled student is expected to satisfy the technical and entry requirements prior to applying for any of the courses. This includes but is not limited to, a computer in working order with an updated software; functional access to the Internet and a sufficient knowledge of using installed software and browsers as well as operating the operation system.
Certificate and Diploma courses:
All coursework and questions must be submitted as instructed by the tutor either online or via the classroom.
Course Materials: It is student responsibility to ensure that all course materials / documents / etc are kept safely and securely as these will only be provided once. Access to course materials is provided solely online except for the perfume materials which will be sent to you, when applicable, and are included in the course fee for uk and EU students.
Please note that the student kit has been designed to allow you to perform the exercises set up in the course programs. If the student runs out of materials, a list of reliable suppliers will be provided by our service on demand.
To ensure course material arrives safely, The Perfumery Art School UK uses the services of courier delivery companies. To this effect, all students are required to provide the school with a physical address in their home country. Postal boxes are not accepted.
the school cannot be held liable for delays incurred during transit. as a general rule, the school will only answer any query about shipped goods if the delay exceeds 3-4 weeks.
Please note that it is the responsibility of the student to organise or pay for any customs charges or related fees likely to be required in some countries. The School will not be liable for any damages, losses or prejudices caused by the non-payment of the said charges by the student and resulting in the perfume starter kit being sent back or disposed of by the local customs or Health authorities.
Course Duration: It is the student responsibility to ensure they have read and understood the course descriptions on our website and in any separate information that may have been sent which clearly state the duration of the course.
In exceptional circumstances such as bereavement or illness, the School may grant extra time to the student to complete their study. Please see our Section on Course Completion below for further details.
Course completion: The student has 12 months to complete the Certificate course program and 24 months to complete the Diploma course program. If you have not completed within that timeframe, the student will exceptionally be given an extension of 12 months. Upon that period, the school will file you as ‘dropped out’ or the student will need to pay an admin fee of £250 (GBP 250) per each year of extension.
Except in case of exceptional circumstances validated by the Perfumery Art School, students who have not completed the course in time will be deemed having dropped out of the said course. The School will not deliver any further tutor support to a student after the course deadline has expired and the student will not be able to claim any compensation thereof nor be qualified to receive the certification. The student will, however, still have access to the course modules WITHOUT TUTOR SUPPORT for a period of 12 months after the expiry date.
Exceptional and reasonable circumstances include pregnancy, bereavement and illness. It is advised to notify us immediately so that we can suspend the training until you can return to the course. In any case, the maximum suspension period allowed will be 12 months.
Workshops and field trips acceptance: Students need to enrol and have paid in full prior to 31st December of the current academic year and to have trained for at least 6 months in order to be able to attend any workshops organised by the school.
However, should any place be available or under special circumstances, the school may accept a student's attendance in the same academic year without any guarantee and obligation to do so and solely at the committee's discretion.
Examination Re Takes: Should a student for any reason fail their online examination or their practical assessment (perfume sample submitted for evaluation), The Perfumery Art School UK offers a one time opportunity of a re-take. Retaking an examination should be done within 6 months of the date of the first submission.
Certificates and Diplomas sent: Certificates and diplomas are sent twice a year, solely upon completion of all the assignments and the validation of the perfume sample by the committee. The student should ensure the sample reaches the school enough time prior to the sending dates stated above.
Administration Timeframes:
All school official printout certificates and diplomas are sent twice a year to those students who have successfully completed their course programs and have submitted their perfume sample.
The accredited CPD UK certificates and diplomas are sent separately directly by the CPD UK and by email only.
Refunds when applicable will be issued within 21 days of the School having closed the student's registration file.
A charge of GBP 650 will automatically apply if the kit has already been delivered to the student.
If the kit was not shipped to the student, refunds will be issued within 14 days of having received the notification in writing as stated in Clause 2 'Cancellations and Refund policies'.
Diplomas and certificates queries and assignments to tutors will be answered within 30 working days.
Complaints will be responded to within 28 working days.
5. Complaints

6. Transferring the course
We retain the sole discretion concerning whether a course may be transferred from you to a third party. Any such request must be made to Us in writing to [email protected]. This e-mail address is being protected from spambots. You need JavaScript enabled to view it.
If We agree to allow You to transfer to another course, the total fees paid towards the discontinued course will be offset against the cost of the new course, no refund of any difference will be given. However We will require that if the new course is more expensive than the discontinued course, the balance should be paid in full and there will also be a standard £75.00 transfer fee.
7. Warranties & Limitation of liability
(i) We warrant that the Materials will be of satisfactory quality but do not warrant that the Materials will be error free. (ii) We warrant that we will perform any services provided hereunder with reasonable skill and care. (iii) We intend to rely on the written terms set out here. If you require any changes, please ensure you ask for these to be put in writing. In that way, we can avoid any problems surrounding what We, and You, are expected to do. (iv) Other than in respect of liability for personal injury arising from our negligence, we shall not be liable for:
(a) losses that were not foreseeable to both parties when this Agreement was made; (b) losses that were not caused by any breach on our part; or (c) business losses and/or losses to non-consumers.
(v) Our liability for direct losses arising out of our negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this Agreement shall be limited to the total price paid for the Distance Learning Package as quoted. (vi) Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for any indirect or consequential loss or damage whatsoever (including without limitation any loss of profits, loss of revenue, loss of opportunity or your liabilities to third parties) which you may suffer arising out of or in connection with this Agreement.
8. Payments
The total and full cost of the course MUST be paid for prior to the course starting and to us issuing a certificate or diploma.
Payments are accepted in GBP (pound sterling). payments made in euros or us dollars will automatically be converted to GBP at the PAYMENT PLATFORM ONGOING CURRENCY RATE.
We offer a Payment plan option via electronic invoicing with a maximum of 4 consecutive payments, payable before the starting date.To apply for the payment plan, please contact us to: [email protected]
For payments by bank transfer or on invoice, please contact us.
Where payment for your course has been agreed by way of a Payment plan via Debit/Credit Card or via electronic invoicing, You agree to make the required payment on the dates as agreed from outset. In the event of a payment being declined, You agree to pay the sum due within 72 hours of the due date or a £20.00 administration fee will be applied.
Should this payment not be received within 21 days from the aforementioned due date then You will be in breach of contract and the full amount owing for the course will become due for immediate payment.
If You fail to make payment by the due date, We may then require appropriate payment as We, in our sole discretion, think fit. We reserve the right to change the date of the Payment plan or to re-try the failed instalment payment at anytime. Should a debt recovery agency be utilised, further costs may be added to the balance owing to Us of which you must pay. You will deal exclusively with the agency appointed and should the debt not be paid, this may also be lodged with the main Credit Reference Agencies thus affecting your ability to obtain credit in the future.
For the avoidance of any doubt, should You wish to discontinue the course at any time outside the Legal cancellation period, then the full amount for the course will still be due as you have entered into a legally binding contract to pay the course fees in full and any additional fees where appropriate.
Please note that no refund shall be made should you fail to complete the course within the stated period (if applicable).
If you complete your course after the completion date, a charge of £100 will apply for the extra administration costs incurred and the delivery of the certificate or diploma. Please see Section 4. Conditions of use - Course completion for further information.
9. Copyright and intellectual property
All copyright and other intellectual property rights relating to the course materials are either owned or licensed to Us. Copying, adaptation or any other use of all or any part of it without our express permission is strictly prohibited.
Material reference made to other sources is mentioned whenever applicable. You are not allowed to circulate course material, wholly or partly on the Internet or through any other public means without our express written consent. In case of breach of our copyright terms, we reserve the right to seek appropriate legal action under the Intellectual property laws. This includes contacting any ISP provider or social network company and requiring the breached material to be immediately removed.
10. Data Protection & Privacy Policy
This privacy statement applies to any personal data you may give to The Perfumery Art School. We collect any personal data You may give Us when You begin your course. We will also collect contact details from prospective students. We maintain data on your transactions with Us as well as your use of our services. For further details, please read our extended Privacy policy.
We are member of ico WHICH GUARANTEES YOUR DATA IS PROTECTED.
Introduction
The Perfumery Art School needs to keep certain personal data, for example about its staff and students, to fulfil its purpose and to meet its legal obligations, for example to accreditation bodies. To comply with the law, information must be collected and used fairly, stored safely and not disclosed to any other person unlawfully. To do this, the University must comply with the Data Protection Principles which are set out in the Data Protection Act, 1998.
Principles
Personal data shall:
Be obtained and processed fairly and lawfully and shall not be processed unless certain conditions are met.
Be obtained for a specified and lawful purpose and shall not be processed in any manner incompatible with that purpose.
Be adequate, relevant and not excessive for those purposes.
Be accurate and kept up to date.
Not be kept for longer than is necessary for that purpose.
Be processed in accordance with the data subject's rights.
Be kept secure from unauthorised access, accidental loss or destruction.
The Perfumery Art School and all its staff or members who process or use personal information must ensure that they follow these principles at all times. In order to ensure that this happens, the Perfumery Art School has developed this Data Protection Policy.
Status of the Policy
Any member of staff or student who considers that the policy has not been followed in respect of personal data about themselves should raise the matter with the School Committee.
Notification of Data Held and Processed
All staff, students and other users are entitled to:
Ask what information the Perfumery Art School holds about them and why.
Ask how to gain access to it.
Be informed how to keep it up to date.
Be informed what the Perfumery Art School is doing to comply with its obligations under the 1998 Data Protection Act.
Responsibilities of Staff and Students
All staff and students are responsible for:
Checking that any personal data that they provide to the Perfumery Art School is accurate and up to date.
Informing the Perfumery Art School of any changes to information which they have provided, e.g. changes of address.
Checking any information that the Perfumery Art School may send out from time to time, giving details of information that is being kept and processed.
If, as part of their responsibilities, staff collect information about other people (e.g. about students course work or personal circumstances, or about members of staff in their department or research group), they must comply with the Policy and with the Data Protection Guidance Notes.
Students who use the Perfumery Art School INFORMATION TECHNOLOGY facilities may, from time to time, process personal data. The Perfumery Art School will not take any responsibility as to any personal data content published by the student on social networks.
Data Security
The need to ensure that data is kept securely means that precautions must be taken against physical loss or damage, and that both access and disclosure must be restricted. All staff are responsible for ensuring that:
Any personal data which they hold is kept securely
Personal information is not disclosed either orally or in writing or otherwise to any unauthorised third party.
Rights to Access Information
Staff and students and other users of the Perfumery Art School have the right to access any personal data that is being kept about them on computer and also have access to paper-based data held in certain manual filing systems.

The Perfumery Art School aims to comply with requests for access to personal information as quickly as possible, but will ensure that it is provided within 40 days of receipt of a completed form unless there is good reason for delay. In such cases, the reason for delay will be explained in writing to the individual making the request.
Publication of the Perfumery Art School information
Information that is already in the public domain is exempt from the 1998 Act. This would include, for example, information on staff contained within externally circulated publications such as the School Calendar. Any individual who has good reason for wishing details in such publications to remain confidential should contact the Perfumery Art School
Subject Consent
The need to process data for normal purposes has been communicated to all staff, and to students at registration. In some cases, if the data is sensitive, for example information about health, race or gender, express consent to process the data must be obtained. Processing may be necessary to operate Perfumery Art School policies, such as health and safety and equal opportunities.
11. Other terms
(i) No relaxation or indulgence which We may extend to You shall affect our rights under this Agreement.
(ii) If any part of this Agreement is held to be unenforceable the remaining terms and conditions shall continue in force.
(iii) All liabilities or obligations arising under this Agreement shall be enforceable against You after termination of this Agreement.
(iv) The Perfumery Art School UK reserves the right to modify or update the student course at any point during the study or enrolment period. In replacement of the original course enrolled upon, The Perfumery Art School UK will provide a course of the same Level or higher in place of the original enrolment, the course will however be the same subject area. In this case the study period will then resume from the start date of the new course and course expiry will always be the longest study period.
(v) You will notify Us immediately in writing of any change in the address specified. Any notices required to be served under this Agreement, or in accordance with the Act will be deemed properly served if sent by way of prepaid first class post to your last known address.
(vi) This Agreement shall be governed and construed in accordance with the laws of England and you hereby agree to submit to the non-exclusive jurisdiction of the English Courts.
(vii) Calls may be recorded for training purposes.
(viii) We reserve the right to alter the terms and conditions at any time and we will notify students of any changes AND PUBLISH THEM ONTO THIS WEBSITE AND IN OUR MARKETING MATERIAL IF APPLICABLE.
(viii) We will notify you in advance about the schedule, location and costs for optional residential courses. The participation to a residential course does not give the student the guarantee that the entry visa in the country where the residential course takes place will be granted by the officials.
(ix) We are not in a position to help arrange or organise visa matters nor do we act as a sponsor to the student for obtaining an entry and short stay visa. The student will be responsible for his own visa arrangements by contacting the Embassy of the country of the residential course.
(x) Should you be refused a visa by the country where the residential course takes place, all fees paid in advance to us will be reimbursed to you without any charge.
12. Zero Tolerance Policy
The Perfumery Art School UK operates under a zero tolerance policy and will not accept any inappropriate behavior directed at any member of staff under any circumstances. This includes vulgar language and threats via electronic mail, in writing, over the telephone or in person. The Perfumery Art School UK reserves the right to expel any student not abiding by this policy with no entitlement to a refund of fees.
13. Rules for use of the student forum
Prohibited material
The following content is not allowed in the The Perfumery Art School UK forum: spam, pornography, racism, illegal material, political opinions, incitation to violence or links to websites concerned with any of these. Posts containing prohibited material will be immediately removed by the Webmaster and the offending user will be banned from further activity on the Forum and your studies will be terminated.
Commercial Forum Posts
The Perfumery Art School UK Forum is designed for students to share questions and advice and is not to be exploited for commercial purposes. Students expect to hear advice from other students - not companies - and promotional posts could damage the Forum’s integrity. AT TIMES, THE SCHOOL MAY ALLOW A STUDENT TO SHARE THE NEWS ABOUT THEIR NEW BUSINESS ON THE FORUM.
as a general rule, should any student want to share the details of a commercial business that might be a direct or indirect competitor of the school, prior authorisation should be sought to do so.
General conduct and etiquette
Aggressive language towards other users and moderators will not be tolerated. The use of profanity is inappropriate on the forum, as are racial, ethnic, or gender-based insults. We welcome members from all ages, genders, ethnicities and religious backgrounds, and it is important that everyone feel equally comfortable here. Posts that are offensive, insulting, inflammatory or defamatory will be removed without warning.
Moderation of the Forum
Violation of any of these guidelines will be evaluated by a Forum Moderator and consequences imposed as necessary to maintain this discussion board as a friendly and functional place for all members.
At all times, we reserve the right to remove any posts that we deem to be inappropriate, abusive, defamatory or disruptive to the community in general. We reserve the right to ban any member who violates our guidelines or disrupts our community. Warnings will be issued where appropriate.
What to do if you see an inappropriate message If you see a post which appears to violate any of our guidelines, do not respond to it, report it immediately to [email protected]
General
If any of these terms and conditions is determined to be invalid or otherwise unenforceable by reason of the application of any law, such provisions shall be severed and deleted from these terms and conditions and the remainder of these terms and conditions shall continue to have full force and effect.
